Terms and Conditions

This page covers the satisfaction guarantee, the grant of license, and other terms and conditions for using the plan3D software.

Plan3D is protected by domestic and international copyright laws and copyright treaties, as well as other intellectual property laws and treaties which are discussed in this agreement. Giving someone else your password is equivalent to a full copyright violation and subject to all the laws of a copyright violation including a fine up to $250,000 USD for each violation.

The plan3D SOFTWARE is licensed, not sold. Purchase of a plan3D license means you agree with the following terms and conditions to using plan3D. If you do not agree, please contact CustomerService@plan3D.com within three days of ordering for a full refund of your purchase price.

Customer satisfaction is our main goal. If you are not 100% satisfied with your plan3D home design subscription, all you need to do is send us an email requesting a full refund to support@plan3D.com within three business days to receive a full refund of your purchase price. After three business days you will be refunded the full amount of your purchase price minus one month which is calculated at the normal monthly subscription amount, not annually discounted, for each month or partial month used. Because plan3D is a software subscription service this amount will be subtracted from the refund whether you have used the full month or not although the actual expiration of your account will be set to expire at the end of a full month. If you have a single month subscription the same situation applies after three days. You will have the remainder of the month to use plan3D before your subscription actually expires.

Our system requirements specify that plan3D only works in Microsoft Windows 7, Vista or XP. A five dollar charge to cover our costs of the refund will be incurred if you have been refunded in the past, or if the refund is not our fault.

This agreement grants you the following rights: You may install copies of the SOFTWARE on up to two computers to design, develop, and test home designs with the PLAN3D ("PLAN3D") provided that you are the only individual using the SOFTWARE on each computer. If you are a corporation or company, you may designate one individual within your organization to have the right to use the SOFTWARE in the manner described herein. If you desire other persons in your company to use plan3D you must purchase additional licenses for each individual. Any other use of plan3D outside of these restrictions, including, but not limited to password sharing, installing multiple copies at a company, etc. is a copyright violation and will be pursued to the full extent of the law.

All rights not expressly granted herein are reserved by PLAN3D, Incorporated.

Limitations on Reverse Engineering, Decompilation, and Disassembly: You may not reverse engineer, decompile, or disassemble the SOFTWARE, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

Separation of Components: The SOFTWARE is licensed as a single product. Its component parts may not be separated for used on more than one DEVICE.

Trademarks: This license does not grant you any rights in connection with any trademarks or service marks of PLAN3D.

Rental: You may not rent, lease, or lend your license to this SOFTWARE as that is a copyright infringement and punishable under International Copyright laws.

Termination: Without prejudice to any other rights, PLAN3D may terminate this license if you fail to comply with the terms and conditions of this license. In such event, you must destroy all copies of the SOFTWARE and all of its component parts.

All title and copyrights in and to the SOFTWARE (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the SOFTWARE), the accompanying printed materials, and any copies of the SOFTWARE are owned by PLAN3D or its suppliers. All title and intellectual property rights in and to the content that may be accessed through use of the SOFTWARE is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This license grants you no rights to use such content. If this SOFTWARE contains documentation that is provided only in electronic form, you may print one copy of such electronic documentation. You may not copy the printed materials accompanying the SOFTWARE.

You acknowledge that the SOFTWARE is of U.S. origin. You agree to comply with all applicable international and national laws that apply to the SOFTWARE, including the U.S. Export Administration Regulations, as well as end-user, end-use and country/region destination restrictions issued by U.S. and other governments.

If you acquired this SOFTWARE in the United States, this license is governed by the laws of the State of Arizona. If this SOFTWARE was acquired outside the United States, then local law may apply. PLAN3D EXPRESSLY DISCLAIMS ANY WARRANTY FOR THE SOFTWARE. THE SOFTWARE AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLAN3D OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF PLAN3D HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
